Terms & Conditions
Surveillance Conditions.
1. Due to the volatile nature of our industry all employed surveillance services must be paid for prior to commencement. Unless previously agreed.
2. The cost referred to in any surveillance is purely for our time. Unfortunately we can not guarantee any out come. All we can do is use our experience and equipment to stack things in our favour.
3. We can work to flat prearranged costs. However, after notification to the client. when surveillance develops beyond the prearranged fee then our normal hourly rate is chargeable.
4. Surveillance equipment is used widely during any surveillance. The client is responsible for any loss or damaged caused to equipment related to their surveillance job, If related surveillance exceeds £800 then the liability is reduced by 50%
6. It is in the clients interest to assist in the deployment of surveillance equipment. E.g.. If a vehicle tracker is to be fitted then the client will be charged our hourly rate if the vehicle is not there or is not accessible at the arrange time. This rate would be extra to any previous quotation.
5. Privacy Policy. The clients privacy will be respected at all times and will
not be discussed with any third party unless requested by official warrant.
Legislation
The legalities of surveillance and spy equipment varies from product to product and country to country. If you intend to use the evidence for legal purposes you may wish to check the legality of your chosen device in you own country. It is the clients responsibility to check their own legal standing.
Company Purchase Terms.
1.
DEFINITIONS. In these
conditions of sale:
a)
'The seller' means the person , company or the firm selling the goods
b)
'The customer' means the person, company or the firm purchasing the
goods.
c)
'The goods' means the order placed by the customer for the supply of
goods.
2.
GENERAL. Unless otherwise expressly agreed in writing by the seller these
conditions shall apply to all orders received and accepted.
If the customer's order contains printed conditions then such conditions
bind the seller only to the extent that they do not conflict with these
conditions and have been accepted in writing by the seller.
In
the event that the customer is not strictly held to these terms, the seller
shall be entitled to rely on them later if the seller so wishes.
3.VARIATION.
No alterations or variations of the terms and conditions of any order are
binding on the seller unless agreed by the seller in writing. The seller may
substitute products to that of a similar nature without consent from the buyer.
4.
PRICES. Prices given or quoted are exclusive of Value Added Tax or any other
revenue charge like packing, carriage, delivery or handling. If there is any
increase in the cost of the goods to the seller or in the rate of Value Added
Tax prior to delivery or collection of the goods, the price thereof will be
adjusted to reflect such increase. Unless otherwise stated in writing,
quotations are available for acceptance for 30 days from day of issue. There is
a 5% surcharge on credit card holders below £5.00
5.
CANCELLATION. Cancellation of any
order cannot be made without the seller's written consent A 5% charge will made
on cancelled Credit Card orders. Orders accepted by the seller. Can only be
amend by his consent and then only on terms, which will indemnify the seller
against any loss, incurred. Cancellation of any order for a saleable item may be
accepted without charge at the sole discretion of the seller. In event of the
seller accepting cancellation of items, which have being made special to order,
the buyer will be required to pay the whole cost of work involved up to
cancellation
6.
PAYMENT. Payment shall be
made by Account holding customers no later than 30 days from the date of
invoice. All cheques, postal orders
or other forms of payment shall be made payable to 'Mydas"'. In
the case of dispute or legal proceedings the seller's offices at the address
shown on the invoice is to be deemed the place where payment is made.
The seller shall be entitled to charge and the customer shall pay
interest calculated at the rate of 9
% per month upon any invoice not
paid in time in accordance with this clause from the date of issue of the
relevant invoice or invoices.
If
the buyer fails to pay in full for goods delivered by the date for payment under
clause 6 above, the seller shall be entitled to bring action for the price not
withstanding that property in the goods has not passed to the buyer. We reserve
the right to assert any further claims resulting from loss arising from default
in any event. The legal and
non-legal costs (whether or not legal proceedings are instituted) incurred for
enforcing the claim and collecting the debt including the fees of the collecting
agencies and solicitors shall be reimbursed to us.
7.TITLE.
a)
Until payment by the customer of all monies payable by the customer to the
seller under this or any contract, the property in the goods or any part of them
shall not pass to the customer but shall remain with the seller.
b )Until
the property has so passed the customer shall hold the goods as bailee and will
at its own expense keep the goods safe and insured against customary commercial
risks and shall keep them separately stored in a readily identifiable state as
the seller's property.
c) Until
the property in the goods has so passed the customer shall return the goods to
the seller on demand and the seller shall without prejudice to any other rights
be entitled to go upon the property of the customer and repossess and remove the
goods.
d) The
customers shall be at liberty to sell the goods in the ordinary course of
business. The proceeds of any such
sale and the benefit of any contact of sale shall be the property of and held in
trust for the seller absolutely, separate from its own monies in a separate
account.
8.PASSING
OF RISK. The goods shall be at the
customer's risk from the date of delivery. It is the buyer responsibility to
ensure the use of the supplied equipment is legal in the country of use.
9.DESPATCH.
Time of despatch shall not be of essence of the contract.
Delivery of the goods may be wholly or partially suspended (as the case
may require) during any delay in the preparation or manufacture of the goods for
whatever reason. The customer shall
not hold the seller responsible for any direct or indirect loss which may arise
if delivery is delayed.
10.DAMAGE
OR LOSS IN TRANSIT AND SHORTAGE. Where the seller has agreed to deliver the goods no liability
is accepted by the seller for the damage or loss during or any shortage. Unless
the customer Signs that they have received Damaged or unchecked goods on the
Consignment note and notifies the seller in writing within three days of receipt
of the goods. In any event, the seller's liability shall be limited under clause
12 hereof. Notification to the
seller must in all cases be given to the address shown on the invoice.
11.GENERAL
LIABILITY. The seller's liability
for any loss and/or any damage whether direct or indirect consequential or
howsoever caused shall be limited to replacement at the option of the seller of
the goods which are notified to the seller in writing as being defective within
three days of the date of delivery provided that the seller shall be under no
liability if the customer fails to adhere strictly to the terms of payment
provided for herein or if the goods have not been used or retained reasonably or
properly.
12.ASSIGNMENT.
The contract of which these conditions form part is personal to the
customer who shall not assign the benefit thereof without the seller's written
consent.
13.LEGAL
CONSTRUCTION. The contract shall in
all respects be constructed and operated as an English contract and conformity
with English law and subject to the exclusive jurisdiction of the English
courts.
14.
RETURNS. Due to the volatile nature of this
industry we offer a none refund basis. This course of action is due buyers
purchasing equipment, use it, catch something, and then suddenly realise they
have no more use for the equipment and try to return it. If the delivered items
are unsatisfactory they need to be returned within three days with a receipt. No
refund will be offered, only a credit note. Less 10% handling and any incurred
delivery costs. If the items are damaged/faulty then these may be returned with
14 days. They will be repaired of replaced at the sellers discretion. If a fault
develops over 14 days then the item will be covered by the manufacturers
warranty and recourse should be made towards the manufacturer.
15.
DEFECTS AFTER DESPATCH All goods
will be examined for condition upon disclosure of defects. Faults due to
manufacture will be covered by the product guarantee
and will be replaced or repaired free of charge. If it is proven that failure had been caused
by bad fitting, misuse or under specification, replacements or
repairs will be deemed chargeable at current price. It is the customer's
responsibility to return faulty items back to the manufacturer, and comply to
the manufactures warranty terms.
